1. What information do we collect?

Personal information you disclose to us. In short: we collect personal information that you provide to us. We collect personal information that you voluntarily provide when you register on the Services, express an interest in obtaining information about us or our products and Services, participate in activities on the Services, or otherwise contact us. This may include contact or authentication data, usernames, email addresses, and names.

Sensitive information. We do not process sensitive information.

Payment data. We may collect data necessary to process your payment if you make purchases, such as your payment instrument number and the security code associated with it. All payment data is stored by Roku, Google, Apple, Amazon, Vizio, Revel Systems, Square, Aloha, Toast, Lightspeed, Clover, RAIN, or any other relevant Point-of-Sale system, where you may find their privacy notices.

Service data. If you use our services, we may also collect the following with your permission:

  • Geolocation information. We may request access to track location-based information from your mobile device to provide certain location-based services. You can change permissions in your device settings.
  • Mobile device data. We automatically collect device information such as device ID, model and manufacturer, operating system, version and configuration information, browser type and version, ISP and/or mobile carrier, and IP address.

Information automatically collected. In short: some information — such as your IP address and/or browser and device characteristics — is collected automatically when you visit our Products or Services. This includes log and usage data, device data, and location data, primarily needed to maintain the security and operation of our Services and for internal analytics and reporting.

2. How do we process your information?

In short: we process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We process your personal information to: facilitate account creation and authentication; deliver and facilitate delivery of services; respond to inquiries and offer support; send administrative information; fulfill and manage orders; request feedback; send marketing and promotional communications (subject to your preferences); deliver targeted advertising; protect our Services; identify usage trends; determine the effectiveness of campaigns; and save or protect an individual's vital interest.

3. What legal bases do we rely on?

In short: we only process your personal information when we have a valid legal reason to do so.

If you are located in the EU or UK, we may rely on: Consent (which you can withdraw at any time), Performance of a Contract, Legitimate Interests, Legal Obligations, and Vital Interests.

Digital Services Act (DSA) Compliance Statement (EU). As a digital service provider and commercial trader operating in the EU, API Automations affirms its compliance with the requirements set forth under the European Union Digital Services Act (EU Regulation 2022/2065), including submitting accurate trader information, clearly identifying commercial communications, providing clear pre-contractual information and accessible support, implementing complaint-handling and takedown procedures, and cooperating with platform audit and transparency requirements. If you are located in Canada, we may process your information with your express or implied consent, which you can withdraw at any time. In some exceptional cases we may be legally permitted to process information without consent as set out under applicable law.

4. When and with whom do we share your information?

In short: we may share information in specific situations described below. We may share your information in connection with business transfers (any merger, sale of assets, financing, or acquisition), with business partners to offer certain products or promotions, and via an offer wall (a third-party-hosted consent screen, paywall, or offer wall), where a unique identifier such as your user ID may be shared with the offer wall provider to prevent fraud and credit your account.

5. How long do we keep your information?

In short: we keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice unless otherwise required by law. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or securely store and isolate it until deletion is possible.

In short: we aim to protect your personal information through a system of organizational and technical security measures. However, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure. Transmission of personal information to and from our Services is at your own risk.

7. What are your privacy rights?

In short: in some regions, such as the EEA, UK, and Canada, you have rights that allow you greater access to and control over your personal information. These may include the right to request access, rectification or erasure, restriction of processing, and data portability, and in certain circumstances the right to object to processing. If you are located in the EEA or UK and believe we are unlawfully processing your personal information, you also have the right to complain to your local data protection supervisory authority (see ec.europa.eu/justice/data-protection) or, in Switzerland, the Federal Data Protection and Information Commissioner (edoeb.admin.ch).

Withdrawing your consent. You can withdraw your consent at any time by contacting us. This will not affect the lawfulness of processing before withdrawal.

Opting out of marketing. You can unsubscribe at any time via the link in our emails, by replying "STOP" or "UNSUBSCRIBE" to SMS, or by contacting us.

Account information. To review, change, or terminate your account, contact us or update your account. Upon request to terminate, we will deactivate or delete your account, though we may retain some information to prevent fraud, troubleshoot, assist investigations, enforce our terms, and/or comply with legal requirements.

8. Controls for do-not-track features

Most browsers and some mobile operating systems include a Do-Not-Track ("DNT") setting. At this time, no standard exists for recognizing or honoring DNT signals. While we do not respond to DNT signals, we do honor the Global Privacy Platform (GPP) and similar Universal Opt-Out Mechanisms. When such signals are detected, we apply your preferences in accordance with relevant state and global privacy regulations.

9. Do California residents have specific privacy rights?

In short: yes — if you are a resident of California, you are granted specific rights regarding access to your personal information. California Civil Code Section 1798.83 ("Shine The Light") permits California residents to request, once a year and free of charge, information about categories of personal information disclosed to third parties for direct marketing purposes. California residents under 18 with a registered account may request removal of data they have publicly posted.

10. Multi-State Privacy Agreement

Under the Multi-State Privacy Agreement (MSPA), CPRA, Colorado Privacy Act (CPA), Virginia Consumer Data Privacy Act (VCDPA), Utah Consumer Privacy Act (UCPA), and Connecticut Act Concerning Personal Data Privacy (CAPDP), residents of these states have additional rights. As a US resident, you may, twice every 12 months: request a copy of the personal information collected about you in the previous 12 months; request details about categories of information collected, sources, purposes, and third parties; request deletion (subject to exemptions); and opt out of the sale of your personal information.

API Automations has not disclosed or sold any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months. We may sell de-anonymized information in the future. We will not discriminate against you for exercising your privacy rights. Upon receiving a request, we will verify your identity before responding.

11. Global Privacy Platform (GPP) & Universal Opt-Out

API Automations honors Universal Opt-Out Mechanisms (UOOM), including the Global Privacy Platform (GPP) browser signal. When received, we automatically opt out of the sale or sharing of personal information, disable personalized or cross-context behavioral advertising, and limit collection and use of data for targeted marketing or profiling. You can also manage data deletion, advertising opt-out, and email preferences via your account privacy dashboard.

12. Do we make updates to this notice?

In short: yes, we will update this notice as necessary to stay compliant with relevant laws. The updated version will be indicated by an updated "Revised" date and will be effective as soon as it is accessible.
